Sample FOIA Letter 

Canada geese are afforded protected under the Migratory Bird Treaty Act, therefore, no action may be taken against the geese without permission, i.e., obtaining a Depredation Permit from U.S. Fish and Wildlife Service. Depredation Permits authorize those seeking relief from human/goose conflicts to have X number of geese “lethally” removed.

Copies of Depredation Permits are available upon request under the Freedom of Information Act. If you would like to know whether or not your municipality and/or county has been issued a Canada goose Depredation Permit, a sample FOIA letter has been provide, below, for your convenience. Re: FOIA request 

Dear FOIA Officer, 

Under the Freedom of Information Act, I am writing to request a copy of the 2008 Depredation Permit, issued to Starlight Township, New Jersey - or any Department within, such as Parks and Recreation – authorizing the removal (take) of Canada geese. If the permit is limited to “egg destruction”, please disregard my letter. 

I am willing to pay up to $20.00 for processing my request. Should the fee exceed $20.00, please contact me before processing. If you have any questions regarding my request, please contact me at (phone number).

Notes of Interest 

1. The processing fee that appears in the sample letter, above, is arbitrary and likely to be “waived” because processing one or two documents is not likely to exceed the fee threshold.
